Vilnius City District Court acquitted a NOOR client of all charges of fraud and document forgery. She was the only one of the three individual defendants in the case to be acquitted. The client was represented by NOOR Partner and Attorney-at-Law Giedrius Danėlius.
The client, who worked as a sales manager at an orthopaedic services company, was accused of participating with other defendants in an alleged scheme through which two companies received more than €1.5 million in reimbursements from Lithuania’s National Health Insurance Fund (NHIF). She faced four charges of fraud and document forgery relating to two separate episodes of the case.
The court found that there was insufficient evidence directly linking the client to the alleged criminal conduct. It was not established that she had instructed employees to forge doctors’ referrals, submit false information to the NHIF or received any part of the funds allegedly obtained unlawfully. The court also noted that the alleged instructions to forge documents were not confirmed by the administrators who testified in the proceedings, while one witness’s evidence concerning doctors’ stamps was not corroborated by other evidence in the case.
The court considered the client’s work with prospective customer lists, sales plans and task allocation to fall within her ordinary employment responsibilities. Having assessed the evidence as a whole, the court concluded that there was no reliable evidence proving her guilt and acquitted her on the basis that her participation in the alleged offences had not been established.
The NOOR client was acquitted of all four charges brought against her. Under the same judgment, the other two individual defendants and both companies charged in the case were found guilty.
