Successful dispute against the Centre for Health Emergencies

Daiva Lileikienė and Karolina Keršytė successfully represented the interests of the client UAB Elymus in a dispute with the Centre for Health Emergencies of the Ministry of Health. The dispute arose from the technical characteristics of an Ultra Low Temperature Deep Freezer offered by another market player. The client succeeded in demonstrating that electric door heating is not considered to be identical to heating that uses the heat generated by a refrigeration unit.

The case involved the need to delve into the highly technical issues of the characteristics of medical devices, to properly present them to the court and to show specific differences that would confirm the non-equivalence of the solutions.
